Terms & Conditions

Studio 621 Films Canada Inc., DBA Studio 621, operating as Studio 621 Films · Nirmal Shah Photography · Wedlock Films. Looking for the short version? See our Booking Terms.

1. Acceptance

These Terms govern use of our website and all photography, film, editing, creative direction, studio rental, digital products and related services provided by Studio 621 Films Canada Inc., operating as Studio 621 Films, Nirmal Shah Photography and Wedlock Films ("the Studio", "we", "us").

By using our website, submitting an enquiry, making a payment or booking our services, you agree to these Terms. You must be at least the age of majority in your jurisdiction. Minors take part only with the consent and supervision of a parent or guardian. Our Privacy Policy forms part of these Terms. We may update these Terms, and the current version is the one published here.

Where a signed agreement for a specific project says something different, that agreement takes precedence over these Terms.

2. Our services

We provide photography and film on location and in our North Vancouver studio, covering portraits, headshots, personal branding, family, commercial and brand work, real estate, events and weddings; podcast and multi-camera production; post-production; creative direction; studio rental; and digital products delivered online.

All services are subject to availability. For work outside British Columbia, the client is responsible for agreed travel, accommodation, permits and access. These Terms remain governed by British Columbia law unless local law requires otherwise.

3. Booking and payment

  • Confirmation. A booking payment holds your date. No booking is confirmed until it is received. The booking payment is applied to your balance and is not refundable
  • Balance. Due as set out on your invoice or agreement, and before final files are released unless we have agreed otherwise in writing
  • Payment. In Canadian dollars by the methods we accept. Any processing or conversion fees are the client's
  • Taxes are added and itemised as the law requires
  • Travel costs — mileage, flights, accommodation, meals and permits — are additional and agreed in advance
  • Late payment may delay delivery, suspend work, hold files, or result in cancellation, interest or collection
  • Online requests. An automated confirmation does not guarantee availability. We may accept or decline a request, and payment for a declined booking is refunded in full

4. Delivery and galleries

We deliver through secure online galleries and portals. Access details are yours to keep confidential. Delivery timelines are estimates unless guaranteed in writing. Proofs may be watermarked and are for selection only.

Galleries are available for the period stated in your agreement. Please download and keep your own copies of delivered files. If you do not raise a material issue within fourteen days of delivery, the work is taken as accepted.

5. Creative control and revisions

You engage us for our style and professional judgment. No specific image, moment or outcome is guaranteed. Final selection and editing decisions are ours. RAW files and unedited footage are not supplied unless agreed in writing.

One round of minor revisions is included if requested within fourteen days of delivery. Further revisions, additional edited images and changes of scope are charged at our current rates.

6. Studio rental

  • A two-hour minimum applies to all rental bookings
  • Monthly credit plans are used within the month and do not carry over. There is no annual commitment
  • Renters bring their own equipment as standard. Studio lighting, video equipment, assistants and consumables are booked as add-ons and charged separately
  • Confirmed bookings are never displaced. Credit-plan clients have preferred advance access to the calendar
  • The renter is responsible for their own conduct, their guests and their equipment, and leaves the space as they found it. Damage, excess cleaning and overruns are charged
  • Renters hold their own insurance where their work requires it

7. Cancellation, rescheduling and events beyond control

  • Your cancellation. Booking payments are not refundable. Further fees may apply depending on timing and scope
  • Rescheduling is subject to availability. Repeated changes may require a new booking payment
  • Not attending without notice is treated as a cancellation without refund
  • Our cancellation. If we cannot carry out the work, we will reschedule or refund the part not delivered
  • Beyond reasonable control. Neither of us is liable for failure caused by weather, natural events, government restriction, illness, travel disruption or similar. Refunds may exclude costs already committed and unrecoverable

8. Digital and physical products

Digital products are licensed, not sold, and remain our property. Licences are non-exclusive, non-transferable and for personal or internal business use. They may not be resold, redistributed, sublicensed or extracted. Digital sales are final except where the law requires otherwise; corrupted or incorrect files are replaced.

Custom physical products such as prints and albums are not returnable except for manufacturing defect or damage, reported promptly.

9. Ownership and usage rights

  • Ownership. All photographs, films, recordings and edits remain the property of Studio 621 Films Canada Inc. unless transferred in writing.
  • Personal clients. On full payment you receive a licence to use the delivered files personally — sharing, social media and personal prints. Commercial use is licensed separately.
  • Commercial clients. The scope of use is set out in writing. Copyright remains with us unless transferred by agreement.
  • Third parties. You may not pass usage rights to vendors, venues, publications or media without our written permission. They are welcome to contact us directly.
  • Alterations. Delivered images and films are used as supplied. Please do not crop, recolour, filter or otherwise alter them, or remove credit or metadata.
  • Our own portfolio. We may show selected work from your project in our portfolio, website, social media, showreels and printed material. Tell us at any time if you would rather we did not, and we will remove it from our own channels. Full detail is in our Privacy Policy.
  • Materials you provide. You confirm you hold the rights to anything you supply to us, and you cover us against claims arising from it.

10. Limits of our liability

To the fullest extent the law allows, our liability is limited to the amount paid for the service in question. We are not liable for indirect or consequential loss, for business outcomes, or for conditions and third-party interference beyond our control. Nothing here limits liability that cannot lawfully be excluded.

11. Indemnity

You agree to cover Studio 621 Films Canada Inc., its people and contractors against claims, losses and legal costs arising from your misuse of deliverables, breach of these Terms, unlawful conduct, or materials you supply without the rights to do so.

12. Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these Terms.

13. Use of our website

Please do not misuse the website or client portals — no unauthorised access, scraping, automated harvesting, malicious uploads or infringement of intellectual property. We may end access where this happens.

14. Governing law and disputes

These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada. We will both attempt to resolve any dispute in good faith first. If proceedings are necessary they take place in British Columbia, unless consumer protection law requires otherwise.

15. Electronic communication

You agree to receive notices, invoices, agreements, approvals and records electronically. Electronic approvals have the same effect as a signature where the law allows.

16. Informal statements

Marketing material, social media posts and conversations do not create obligations beyond what is agreed in writing.

17. Third-party platforms

We use established platforms for delivery, hosting, scheduling and payment. We are not responsible for their outages or failures.

18. Editing tools

We may use AI-assisted tools from time to time to support editing and file workflows. Creative judgment, authorship and ownership remain ours.

19. Trade marks

Studio 621, Studio 621 Films, Nirmal Shah Photography and Wedlock Films, together with their branding, are our trade marks and trade dress. All rights not expressly granted are reserved.

20. Miscellaneous

  • Severability — if part of these Terms is invalid, the rest stands
  • No waiver — not enforcing a term does not waive it
  • Entire agreement — these Terms, the Privacy Policy and any signed agreement form the whole agreement
  • Assignment — rights under these Terms are not transferable without our consent
  • Independent contractor — nothing here creates a partnership or employment relationship
  • Survival — ownership, liability, indemnity and governing law survive the end of the agreement
